The family of Lafayette Palmes, who died from dehydration during an extreme heat wave, has filed a wrongful death lawsuit against multiple parties, including Maricopa County. Palmes was under county guardianship at the time of his death, highlighting serious issues within the guardianship system regarding care for individuals with mental health challenges. The lawsuit aims to seek justice and accountability for his tragic passing, which occurred on a day when temperatures reached 116 degrees Fahrenheit.
Phoenix – The family of Lafayette Palmes, a 58-year-old man who died from heat exposure and dehydration during an extreme heat wave, has initiated a wrongful death lawsuit against multiple parties, including Maricopa County. Palmes was found deceased in an alley on July 6, 2023, on a day when temperatures soared to 116 degrees Fahrenheit.
In their lawsuit, the family seeks accountability for the circumstances surrounding Palmes’ death, emphasizing that he was under the guardianship of Maricopa County at the time. Family members have expressed their determination to serve as advocates for Palmes, stating that he lacked a voice to speak for himself. The case underscores critical issues related to the guardianship system and the oversight required for individuals with mental health challenges.
Palmes was known by his family as an intelligent and kind individual, previously excelling as a straight-A student. However, he faced significant mental health struggles from a young age, receiving a diagnosis of schizophrenia in his 40s. Following the death of his mother in 2020, his sister transported him to Arizona but eventually found she could no longer provide the care he needed. Consequently, he was placed under permanent guardianship with the Maricopa County Public Fiduciary and was required to receive round-the-clock care.
Close relatives, including his cousin, attempted to assist in Palmes’ care. A family member contended that they made efforts to bring him back into a familial living situation, highlighting ongoing concerns about his well-being. The family only learned of his death through a phone call, which provided limited information about the events leading up to it.
Just prior to his death, Palmes had been relocated to a Chandler assisted living facility, where it was reported that he had not received his prescribed medication for schizophrenia while staying at a previous establishment. A behavioral health medical team, Resilient Health, was responsible for arranging his transportation to a medical appointment, but records indicate that he did not arrive at the clinic.
The Chandler facility claimed that Palmes did not return, but it appears that the information regarding his absence was not communicated to the county until several days later. Moreover, Chandler police became involved on July 9 after they were alerted to Palmes’ disappearance, while Phoenix police discovered his deceased body on July 6.
A medical examination concluded that Palmes died due to dehydration and heat exposure, with his body temperature reported to be nearly 110 degrees Fahrenheit. The asphalt temperature at the time was recorded at 157 degrees. Family members reported viewing severe burn marks on his body, suggesting prolonged exposure to the pavement under the extreme heat conditions.
Adding to the family’s distress, they found that the contact number for the Chandler assisted living facility had been disconnected, raising questions concerning the facility’s accountability. The family is now demanding a jury trial to seek justice for Lafayette’s death and to address the broader implications of guardianship and care for those with mental health conditions.
As the lawsuit proceeds, Maricopa County officials have not provided comments on the claims made against them. This case has ignited discussions surrounding the responsibilities of guardianship systems and the necessary measures to protect individuals struggling with mental health issues. The family hopes that their pursuit of justice will not only honor Lafayette Palmes’ legacy but also bring greater awareness to the challenges faced by vulnerable populations in similar circumstances.
