Jesse Johnson, who found himself at the center of a controversial and tragic event, is now suing the City of Phoenix and former interim police chief Michael Sullivan for what he claims is wrongful termination.
The incident in question took place on September 24, 2022, when 34-year-old Ali Osman was fatally shot by Johnson during a confrontation. Osman allegedly began throwing rocks at cars in the vicinity, specifically near 19th and Glendale avenues, and later turned his attention to the officers who responded to the scene.
Things escalated quickly when one of the rocks thrown by Osman pierced the hood of a police SUV and another shattered a spotlight on the vehicle. In what Johnson describes as a tense moment, he and another officer made the fateful decision to open fire, resulting in the tragic death of Osman due to a gunshot wound to the neck.
Following the shooting, questions arose regarding the officers’ actions. However, Maricopa County Attorney Rachel Mitchell decided not to pursue any criminal charges against Johnson or his colleague. An internal review by the department’s Critical Incident Review Board examined the use of force during this incident and concluded that Johnson’s actions were in accordance with department policy.
The narrative took a sharp turn in April 2024, when Interim Chief Michael Sullivan sent an email indicating that Johnson’s handling of the shooting incident was deemed out of policy. This conclusion set the stage for Johnson’s termination, which he argues was based on four alleged violations of city personnel rules, including a significant breach of the “Sanctity of Life” policy, which highlights the importance of valuing human life.
In his federal lawsuit, Johnson argues that he has been treated unfairly compared to his colleague involved in the incident. While Johnson faced termination, his fellow officer received only a 24-hour suspension for firing at Osman.
