Reports indicate that numerous tenants have been dealing with air conditioning issues since as early as Friday, with many expressing frustration over ongoing problems that have persisted over the years, particularly during the summer months. The latest breakdown followed an electrical outage at the complex, located near 43rd Avenue and Thomas Road. Prior to noon, thermostats in tenant units and hallways registered a sweltering 95ºF.

To mitigate the situation, complex management allowed residents to stay in a clubhouse area, though many tenants voiced concerns about privacy and the uncomfortable conditions for older residents. While some tenants managed to cope with the heat through family support, others—especially those with pets—were left in difficult situations without assistance.

City officials have been informed of the situation, with the Human Services Department beginning door-to-door outreach to evaluate the needs of affected residents. The Neighborhood Services Department (NSD) also dispatched inspectors to the property and issued a 24-hour Notice of Ordinance Violation regarding the air conditioning issues. If management fails to address the situation satisfactorily in the designated time frame, citations could be issued for every affected unit.

The Attorney General’s Office has acknowledged the seriousness of the air conditioning failures and is currently investigating the matter. Residents have been encouraged to lodge complaints with the office, and investigators have been sent to monitor compliance on-site to ensure necessary repairs are completed.

While Arizona law does not require landlords to provide air conditioning, it mandates that existing cooling systems must be maintained in proper working order. Additionally, cooling ordinances in both Phoenix and Tempe stipulate that rental units must be kept at safe cooling temperatures. Tenants are advised to submit written repair requests to their landlords, necessitating repairs to be finished within ten days. Furthermore, utility companies are prohibited from disconnecting services during extreme weather conditions.

In response to the crisis, the Salvation Army operates cooling stations throughout the city to provide relief to individuals lacking adequate air conditioning. This service has become increasingly critical as many residents, particularly seniors on fixed incomes, face tough choices between maintaining air conditioning and handling other essential expenses.

The complexities surrounding tenant rights and property management responsibilities are evident in this ongoing crisis.
